Acquiring and Selling Freehold Premises

Dilapidations and Repairs

A commercial lease will contain repairing obligations. Sometimes a property will fall into disrepair and steps will need to be taken to address the problem. We advise landlords and tenants in these situations, in conjunction with your other professional advisers.

Financing

Once the most appropriate means of financing your commercial property investment has been decided upon, we can advise you in relation to the terms of the proposed finance. We advise regarding the implementation of commercial mortgages and also in relation to the taking of security in support of them.

Forfeiture

When a tenant is unable to pay rent, the landlord may wish to forfeit the lease in order to recover the property. We advise in relation to the recovery of rent and the forfeiture process. We also advise on the insolvency aspects of these situations.

Lease and Rent Reviews

We advise on the terms of the lease, the rights granted, the obligations of each party and on a variety of other considerations. We also assist in relation to the rent and rent review process.

Licences

Commercial property may often be the subject of a licence, whether in relation to the whole of the premises occupied or to part of it (such as a car park). We advise on the terms of the licence, including the delineation of the property which is licensed, the licence fee and the obligations of each party to the other. We assist you in negotiating and implementing the most appropriate arrangements.

Property Development

We advise in relation to the acquisition of land, whether for residential or commercial development purposes. We assist in the planning process, in relation to environmental considerations and on the legal issues arising from the proposed use of the land. We also advise in relation to compulsory acquisition of premises, compensation, special controls and highways issues.
