The purpose of the legal process of buying and selling of freeholds is to ensure that the title to the land is guaranteed and that there will be no dispute regarding ownership. The legal process is also intended to ensure that the price and terms for the property (and for any additional items, such as fixtures and fittings) are properly set out and agreed. Very often, your transaction will be one of several in a chain. We recognise how stressful moving house is. It is most important that the terms of the lease (including the obligations to contribute to the upkeep of the building and the common parts) are properly understood. We also have wide experience of assisting tenants in the purchase of freehold properties, including setting up the necessary management companies to facilitate this.
We will explain the legal aspects of the mortgage to you and guide you through the steps necessary to put the mortgage in place, swiftly and effectively. When the time comes for you to change your mortgage, we can assist you in re-mortgaging your home.
Occasionally due to changes in personal circumstances such as relationship breakdowns the ownership of your property and the mortgage obligation need to be transferred out of joint names into one name or the names of other persons. Our Conveyancing team have experience of dealing with such transfers and can advise on the Stamop Duty Land Tax implications, Land Registry transfers and can act in any associated re-mortgage.
You may want to put your property in trust for tax reasons or to safeguard it for future purposes. We have extensive experience in drafting and advising on the different types of trust, their effects and tax implications. We can also advise on the implications and means of removing the property from a trust.
