We can pursue assets held by the insolvent individual or a third party and advise on retention of title clauses, and tracing procedures, as well as bring proceedings or negotiate in relation to the property in question.
We can assist in relation to the sale of freehold, leasehold, intellectual and other property held by the insolvent individual.
We can advise in relation to issues arising during the course of the bankruptcy, including asset recovery, third party claims, pursuing debtors of the bankrupt person, and in relation to land and property issues.
We can assist in drafting and pursuing a bankruptcy petition through to a bankruptcy order against a creditor who is unwilling or unable to discharge your debt. We can also assist in defending against a petition that has been brought against you. We can assist if a bankruptcy order has been made and might be removed.
We can advise in relation to liability under a mortgage or charge that you may have entered into and in relation to liability under a personal guarantee. In particular, we can assist in negotiating with creditors.
We can advise debtors and insolvency petitioners in relation to the legal aspects of individual voluntary arrangements and assist in Court applications.
We advise in relation to the setting aside of transactions, where property belonging to a bankrupt individual has been disposed of at an under-value on preferential terms. We can advise in relation to transactions of defrauding creditors, and on the procedures necessary to bring claims in the County Court or the High Court. We can assist in negotiations or in alternative dispute procedures.
We can advise in relation to the drafting and service of a statutory demand, as well as applications to the Court for setting aside the statutory demand.
