Residential Property

For those owning a property, it is often the most expensive thing that you will have ever purchased. To maximise your enjoyment and investment, you might move house, or as your existing house increases in value, you might re-mortgage – perhaps to extend the property or to invest in ‘buy-to-let’ schemes.

Not only is this an expensive exercise, but pitfalls abound. The terms of mortgages, payment of Stamp Duty Land Tax and fees, planning issues and problems with tenants or neighbours can all tarnish the property-purchasing experience.

Freehold sale or purchase
The purpose of the legal process of buying and selling of freeholds is to ensure that the title to the land is guaranteed and that there will be no dispute regarding ownership. The legal process is also intended to ensure that the price and terms for the property (and for any additional items, such as fixtures and fittings) are properly set out and agreed. Very often, your transaction will be one of several in a chain. We recognise how stressful moving house is. Leasehold sale or purchase
It is most important that the terms of the lease (including the obligations to contribute to the upkeep of the building and the common parts) are properly understood. We assist you in asking and answering the appropriate questions, and in ensuring that the legal title to the property is properly transferred. We also have wide experience of assisting tenants in the purchase of freehold properties, including setting up the necessary management companies to facilitate this.

Mortgage or re-mortgage
We will explain the legal aspects of the mortgage to you and guide you through the steps necessary to put the mortgage in place, swiftly and effectively. When the time comes for you to change your mortgage, we can assist you in re-mortgaging your home.
Transfer of Equity
Occasionally due to changes in personal circumstances such as relationship breakdowns the ownership of your property and the mortgage obligation need to be transferred out of joint names into one name or the names of other persons. Our Conveyancing team have experience of dealing with such transfers and can advise on the Stamp Duty Land Tax implications, Land Registry transfers and can act in any associated re-mortgage.
Putting property in trust
You may want to put your property in trust for tax reasons, or to safeguard it for future purposes. We have extensive experience of drafting and advising on the different types of trust, their effects and tax implications. We can also advise on the implications and means of removing the property from trust.
Stamp Duty Land Tax (SDLT)
We will advise you of the Stamp Duty Land Tax implications of your proposed transaction at the outset of the matter.
Energy Performance Certificates (EPC's)
Following a decision by the Government, HIP's are now suspended and the law will be repealed in the 2010-11 session. However every home for sale still requires an Energy Performance Certificate when it is put on the market (or within 28 days thereafter).

We are able to produce an EPC at a very competitive rate.

This inspection usually lasts about 1 hour and involves him measuring the property, checking lighting, radiators, boiler and loft. The resultant report provides an estimate of energy usage and carbon emmissions together with recommendations for improvement..
