The debt recovery process explained

Debt recovery letter

Our first approach in most debt situations is to issue a solicitor’s letter to the person who owes you money. This letter will state:

  • The identity of the debtor
  • Your identity
  • The amount owed
  • The reason for the debt
  • What resolution you are seeking (i.e. repayment of the debt by a specific date)
  • What action you will take if the debt is not repaid
  • The details of any relevant contracts or agreements, as well as the applicable laws
  • Our details

In many cases, this letter will prompt swift payment as it shows the debtor that you are serious and that you will not simply let the matter go.

Negotiating settlement of a debt

In some cases, it may be appropriate to negotiate with the debtor to secure repayment. This might be where there is dispute over the level of the debt or where the debtor says they are willing to pay but cannot do so in full or all in one go.

Our debt recovery solicitors can help you negotiate privately with the debtor, as well as advising on the suitability of options such as mediation. These approaches can help you to settle on an amount the debtor is able to pay that you are willing to accept and/or a schedule of payments if they are unable to pay their debt in a single lump sum.

Obtaining a County Court Judgement (CCJ)

Where a debtor refuses to pay or does not respond to attempts to contact them, it may be necessary to apply to a court for a County Court Judgement (CCJ) against them.

If a court issues a CCJ against the debtor, this means the court is formally acknowledging that the recipient of the CCJ owes you money. The CCJ will also stay on the Register of Judgments, Orders and Fines for six years, significantly affecting the debtor’s credit rating.

Our debt recovery solicitors can handle the process of applying for a CCJ for you. We can complete the necessary paperwork and ensure all relevant evidence is included so you have the best chance of securing the judgement you need.

Having a CCJ issued against a debtor can be very strong motivation for them to pay as, if they pay within one month, they can apply to have the judgement removed from the Register of Judgments, Orders and Fines. This allows them to avoid any harm to their credit rating.

Once a CCJ has been issued, there are also various debt enforcement options than can be used if the debtor continues to fail to make payment.

Enforcement actions

Where a court has ruled that a debtor must pay you and they fail to do so, there are a range of enforcement actions we can take on your behalf.

These include applying to the court to:

  • Require the debtor to attend court for questioning
  • Instruct bailiffs to recover the debt
  • Make an attachment of earnings order (requiring the debtor’s employer to deduct money from their wages to repay you)
  • Place a charging order on the debtor’s property to secure the debt – if the debtor then sells their property, they must repay you from the proceeds

Our debt recovery solicitors will be happy to advise you on these various enforcement options and which are likely to be suitable and cost-effective for your circumstances.
