The debt recovery process explained

Debt recovery letter

Our first approach in most debt situations is to issue a solicitor’s letter to the person who owes you money. This letter will state:

  • The identity of the debtor
  • Your identity
  • The amount owed
  • The reason for the debt
  • What resolution you are seeking (i.e. repayment of the debt by a specific date)
  • What action you will take if the debt is not repaid
  • The details of any relevant contracts or agreements, as well as the applicable laws

In many cases, this letter will prompt swift payment as it shows the debtor that you are serious and that you will not simply let the matter go.

Negotiating settlement of a debt

In some cases, it may be appropriate to negotiate with the debtor to secure repayment. This might be where there is dispute over the level of the debt or where the debtor says they are willing to pay but cannot do so in full or all in one go.

If a court issues a CCJ against the debtor, this means the court is formally acknowledging that the recipient of the CCJ owes you money. The CCJ will also stay on the Register of Judgments, Orders and Fines for six years, significantly affecting the debtor’s credit rating.
